What is litigation?
Litigation is the process of appointing law professionals to resolve disputes in court, in the hope of obtaining compensation for damages. There are a variety of litigation claims that can be made, although they all fall under two major categories – civil litigation and commercial litigation.
The difference between civil and commercial litigation
In terms of procedure, civil and commercial litigation are very similar. They both involve appointing a commercial solicitor, who will conduct an investigation into the case and take the matter to court on your behalf. However, they differ on a couple of key aspects – the first being the ‘parties’ involved.
Civil litigation involves a dispute between two people, where one side requires financial reimbursement (that can’t be obtained without court intervention). By contrast, commercial litigation involves businesses. It’s an umbrella term, used for any dispute resolution claims that arise within a corporate context – perhaps between a company and contractor or shareholder.
They also differ in terms of their complexity. Whilst civil litigation claims are fairly straightforward and quick to resolve, commercial litigation can be complicated and it may take a while to reach a satisfactory outcome.
Here at Prosperity Law, we specialise in both areas. Whether you’re a consumer or employer looking for the compensation that you deserve or a CEO fighting for your business, our team of commercial solicitors are here to help – and can advise on the best way to proceed with your individual case.

Commercial litigation at Prosperity Law
There are numerous commercial disputes that businesses can become embroiled in, which is why our expert commercial litigation solicitors can assist with the following:
Contract breach claims
One of the most important components of running a business is drawing up corporate contracts – whether they are for your employees or third-party contractors. It is vital that all parties understand their terms as well as the implications they will face in the event of a contractual breach. This could be anything from simple mistakes or errors within a written contract to disputes regarding an employee’s inability to adhere to the contract’s terms.
If an agreement regarding the breach cannot be resolved within the workplace, then our professional commercial solicitors can step in – representing your business in the resolution process, with the intention to obtain suitable compensation.
Disputed partnership agreements
Most organisations forge partnerships with various associates, as it is beneficial for business growth. However, as with any relationship, disagreements are inevitable – whether it be disputes over property, asset ownership, insolvency issues or something else.
To resolve any of these partnership issues, the best thing to do is instruct one of our knowledgeable commercial litigation solicitors, who will assist you in working towards a satisfactory resolution.
Shareholder disputes
It is relatively common for organisations to experience shareholder disputes. They are usually a result of a conflict of interest – such as disagreements regarding the direction of a business, how it is being managed, or even the conduct of illegal activity. Any of these factors can result in a breakdown in relationships which can be detrimental to business.
To ensure your business remains successful and shareholder partnerships stay intact, one of our expert commercial solicitors can offer you the advice and guidance you need to continue your business as usual.
