There are a variety of reasons for experiencing problems with pay, whether you are an employee or contractor. The first thing we advise, is talk to your employer and find out why.
If you are struggling to get in contact with your employer, or can’t seem to agree on the amount you are owed– then you are well within your rights to challenge them.
If you choose to challenge them, you should act quickly. It is much harder to recuperate lost wages after 3 months from the date the problem arose.

Common Payment Problems

• Not paid in full for all the hours you’ve worked
• Unexplained deductions in pay by your employer
• Missing pay for time off sick, holiday or parental leave
• The employer has gone out of business or vanished
• Payment dates have been missed by your employer

What Action Should You Take?

If you are experiencing one of these common payment problems, or maybe something more complex, you should speak to your industry trade union. Trade unions can provide great industry specific advice, and can accurately advise you on the next course of action.
If you are not a member of a trade union, or work in an industry where unions are not present – then you can raise a formal grievance against your employer. Most employers have a formal grievance procedure, and even if they don’t, you can still raise a grievance by writing a letter or email. If you don’t feel confident raising a grievance, speak to one of our expert employment team today.
If your grievance doesn’t get the result you want, you can take your employer to a tribunal. Tribunals can be costly and stressful, so it is best to speak to an employment solicitor before raising this action. Depending on your situation, it may be better to agree an ‘early conciliation’ – a way to resolve disputes without having to go to a tribunal.
